 QDo I need a license to sell jellies and jams at a farmers' market?

Q If I am a landscaper, do I need a nursery license?


ATo determine if you should apply as a Nursery Stock Dealer or Nursery Stock Grower, refer to the following:

  • If you plan to purchase from a certified nursery more than half (50%) of the nursery stock you will sell, you should apply as a Nursery Stock Dealer. New applicant fee for your first year is $70.00. Renewal fees will be based upon your gross sales of nursery stock from the previous year.
  • If will grow more than half (50%) of the nursery stock you will sell, you should apply as a Nursery Stock Grower. Fee is based upon the number of acres from which you will sell during the current certificate year. All stock must be inspected before sale. Contact this office to schedule an early inspection.
Q: How do I get certified as a women-owned business?

A: There is no certification process at the Federal level (although there is legislation in process to do so). You simply "self-certify" yourself on the various government forms. If, after a contract award, another vendor decides to protest the award, you may be required to produce "proof" of your status. Some States, however, do have a certification process for State procurements. This process is usually administered through the State's  Economic Development Council. Contact your local SBA office for additional information.

Q: Do I need a license for my new business? I am a sole proprietorship.

A: Maybe yes, maybe no. It is safe to say that most small businesses probably do not need a license. For example, if you will be consulting (a typical and popular small business) it is doubtful that you need a license. However most states have licensing requirements for certain types of businesses and you should check with your local government offices to see if your specific business needs a license. Examples of businesses requiring licensing include Barbers, Attorneys, Doctors, Dentists, Contractors, Insurance Brokers, Opticians, Veterinarians.

Q What is a "noxious weed" and what plants are considered "noxious"?


AThe Minnesota Noxious Weed Program is designed to prevent the harmful effects that undesirable plants can have on the state's citizens. Landowners and land managers, both public and private, are required to control or eradicate noxious weeds on land they own or manage. The Minnesota Noxious Weed Law and Rules have been in existence since 1929 and enforcement is a cooperative effort between state, county, and local governments.
